If you exercise a professional activity, you have the obligation to guarantee your buyers the lack of conformity existing before the purchase:

  • the good is unsuitable for the use usually expected of a similar good
  • the property does not correspond to the description given to the buyer
  • the property does not have the qualities announced or agreed with the buyer.

This warranty applies only to movable goods, such as consumer goods, and allows the defective good to be repaired in favor of the buyer.

3. Respect consumer law

If you are a professional seller and you offer your goods or services to individuals, you are required to comply with consumer law.

Communicate certain information to consumers

You must tell consumers, in a clear and understandable way:

  • your name or business name, registered office address.
  • your telephone number and e-mail address through which we can actually get in touch with you;
  • The essential characteristics of the good or service
  • the total cost of the product or service and any additional charges
  • delivery fees ;
  • the terms of payment, delivery or performance;
  • the duration of the validity of the offer and the price offered;

In addition, at the latest at the time of delivery, the consumer must be provided, in writing or any other durable medium:

  • confirmation of information previously given (your name, contact details, delivery costs, etc.);
  • the address of the supplier's establishment where the consumer can lodge his complaints;
  • information relating to after-sales service and commercial guarantees.

When you buy a product from a professional, the latter must guarantee you against any lack of conformity existing before the purchase:

  • the good is unsuitable for the use usually expected of a similar good
  • the item does not correspond to the description given by the seller
  • the property does not have the qualities announced by the seller or agreed with you.

This warranty applies only to movable property, such as consumer goods, and allows you to obtain repair of the defective good.

It should be noted that the professional can also offer you a non-compulsory commercial guarantee. When a seller speaks of a product “guaranteed for 1 year” (or another period), it is most often the commercial guarantee.

When a good or a service is offered by a non-professional or a consumer, the guarantee depends on two contracting parties, namely; buyer and advertiser.
